Terms and Conditions

 

Refunds:

  • Joseph Pooley Photography will comply with its obligations under the Consumer Guarantees Act New Zealand or any other applicable consumer protection legislation that cannot be excluded. Subject to any such applicable laws, refunds or replacement products or services will be given at the discretion of Joseph Pooley.

 

Booking cancellations:

When a Booking/Order is confirmed by the Client, the Client becomes liable for payment to the Photographer and the Photographer becomes liable to complete the shoot.

  • Cancellation of the Booking/Order by the Client must be in writing and must give reasonable notice to the Photographer. Subject to any specific terms in the Agreement, if the Client cancels the Booking/Order:
  • Within 1 working day of the booked shoot day, the Client must pay a fee of 100% of the Photographer’s fees
  • Giving notice of cancellation of greater than 1 working day and within 3 working days of the booked shoot day, the Client must pay a fee of 50% of the Photographer’s fees.
  • Giving notice of cancellation of greater than 3 working days and within 1 month of the booked shoot day, the Client must pay a fee of 25% of the Photographer’s fees.
  • The Client must pay the Photographer for all Job-Related Costs incurred.
  • The Client acknowledges and agrees that these cancellation fees fairly reflect the loss suffered by the Photographer and the Photographer’s ability to reschedule work and reallocate resources, depending upon the amount of notice given.
  • An admin fee of 10% of the Photographer’s total fee will be payable to the photographer by the client, in the event of any cancellation by the client made 1 month or more before the booked date.

 

Postponement:

Subject to any specific terms in the Agreement, if the Client postpones or changes the date of the Booking/Order, the following shall apply:

  • Within 1 working day of the booked shoot day, the Client must pay a fee of 50% of the Photographer’s daily fee for each day which is postponed.
  • With more than 1 working days’ notice, the Client must pay a fee of 25% of the Photographer’s daily fee for each day which is postponed.
  • The Client must pay the Photographer for all Job-Related Costs incurred.
  • The Client acknowledges and agrees that these cancellation fees fairly reflect the loss suffered by the Photographer and the Photographer’s ability to reschedule work and reallocate resources, depending upon the amount of notice given.

 

Addressing:

  • If a product is found to be mis-addressed by Joseph Pooley Photography then Joseph Pooley Photography shall be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then Joseph Pooley Photography will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer.

 

Tax:

  • Goods & Services Tax (GST) of 15% is included in the prices displayed on this website.

 

Customs & Duties:

  • For any orders shipped outside of New Zealand the customer is the importer of record and will be responsible for all customs import duties and sales tax charges. These charges vary in each country and are outside of Joseph Pooley Photography’s control. Contact your local customs office for more information on what import duties or sales taxes may be imposed.

 

Delivery Estimates:

  • Joseph Pooley Photography makes every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for products on this site assume that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold Joseph Pooley Photography liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

 

Limitation of Liability:

  • The Customer shall indemnify Joseph Pooley Photography against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered due to the act or omission of the customer. Joseph Pooley Photography shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services from Joseph Pooley Photography, even if Joseph Pooley Photography has been advised of their possibility. In no case shall Joseph Pooley Photography’s maximum liability exceed the cost of the relevant original order.

 

Shipping:

  • Joseph Pooley Photography take no responsibility for Lost or damage good’s due to the shipping company. Shipping and Handling fees are included in the “shipping price”

 

Intellectual Property:

  • The photographs contained on this, and any other site under the josephpooleyphoto.co.nz domain, are the property of Joseph Pooley and are protected by New Zealand and International copyright laws. All copyright, trademark, and other intellectual property rights in this site, are the property of Joseph Pooley. All Images remain the sole property of Joseph Pooley. Use of any images is prohibited, unless permission is granted by Joseph Pooley. Pages may be shared on social media or other web platforms. Recognition of images ownership must be given if shared.
