Terms and Conditions

  1. Refunds:Joseph Pooley World Photography will comply with its obligations under the Consumer Guarantees Act New Zealand or any other applicable consumer protection legislation that cannot be excluded. Subject to any such applicable laws, refunds or replacement products or services will be given at the discretion of company management.
  2. Addressing:If a product is found to be mis-addressed by Joseph Pooley World Photography then Joseph Pooley World Photography shall be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address, then Joseph Pooley World Photography will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer.
  3. GST:For New Zealand delivery addresses, all prices are New Zealand GST inclusive unless otherwise stated.
  4. Customs & Duties:For any orders shipped outside of New Zealand the customer is the importer of record and will be responsible for all customs import duties and sales tax charges. These charges vary in each country and are outside of Joseph Pooley World Photography’s control. Contact your local customs office for more information on what import duties or sales taxes may be imposed.
  5. Delivery Estimates:Joseph Pooley World Photography makes every effort practical to ensure that delivery timeframes given are accurate. However the delivery times stated for products on this site assume that delivery times are not adversely affected by unforeseen events. By placing an order, you agree not to hold Joseph Pooley World Photography liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.
  6. Limitation of Liability:The Customer shall indemnify Joseph Pooley World Photography against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered due to the act or omission of the customer. Joseph Pooley World Photography shall not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services from Joseph Pooley World Photography, even if Joseph Pooley World Photography has been advised of their possibility. In no case shall Joseph Pooley World Photography’s maximum liability exceed the cost of the relevant original order.
  7. Shipping:Joseph Pooley World Photography take no responsibility for Lost or damage good’s due to the shipping company. Shipping and Handling fees are included in the “shipping price”
  8. Intellectual Property: The photographs contained on this, and any other site under the josephpooleyphoto.co.nz domain, are the property of Joseph Pooley and are protected by New Zealand and International copyright laws. All copyright, trademark, and other intellectual property rights in this site, are the property of Joseph Pooley. All Images remain the sole property of Joseph Pooley. Use of any images is prohibited, unless permission is granted by Joseph Pooley. Pages may be shared on social media or other web platforms. Recognition of images ownership must be given if shared.
